§ 1 DEFINITIONS
Working days - days from Monday to Friday except public holidays.
Account - a free-of-charge function of the Store (service provided electronically) regulated by separate regulations, thanks to which the Buyer may set up his individual Account in the Store. 
Consumer - a Consumer within the meaning of the provisions of the Civil Code.
Buyer - any entity purchasing from the Shop.
Rules and Regulations - these Rules and Regulations.

§ 3 TECHNICAL REQUIREMENTS
For the proper functioning of the Shop you need: 
A device with access to the Internet
A web browser that supports JavaScript and cookies.
To place an order in the Store, apart from the requirements specified in paragraph 1, an active e-mail account is necessary.
§ 4 SHOPPING IN THE STORE
The prices of goods shown in the Shop are the total prices for the goods, including VAT.
The Seller points out that the total price of an order consists of the price for the goods indicated in the Store and, if applicable, the costs of delivery of the goods. Terms and Conditions
The goods chosen to be purchased should be added to the basket in the Shop.
The Buyer then chooses from the available in the Shop: the method of delivery of the goods and the method of payment for the order, as well as the data necessary to complete the order placed.
The order is placed when the Buyer confirms its content and accepts the Terms and Conditions.
Placing an order is tantamount to concluding a sales agreement between the Buyer and the Seller. Terms and Conditions .
The Seller shall provide the Consumer with a confirmation of the conclusion of the contract of sale on a durable medium at the latest upon delivery of the goods.
The Buyer may register with the Shop, i.e. create an Account therein, or make purchases without registering by providing his/her data with each possible order.
§ 5 PAYMENTS
An order placed may be paid for, depending on the Buyer's choice: 
By ordinary bank transfer to the Seller's bank account.
Cash on delivery, i.e. cash on delivery of the goods to the Buyer.
By card or cash at the time of personal collection of the goods.
If the Buyer chooses to pay in advance, the order must be paid for within 3 Working Days of placing the order.
The Seller informs that in the case of some payment methods, due to their specificity, payment of the order by this method is only possible immediately after placing the order.
By purchasing from the Shop, the Buyer accepts the use of electronic invoices by the Seller. The Buyer has the right to withdraw his acceptance.
 

§ 6 ORDER PROCESSING
The seller is obliged to deliver goods without defects.
The lead time is 2 working days.
If the Buyer has chosen to pay for the order in advance, the Seller shall proceed with the order after it has been paid.
If the Buyer has purchased goods with different lead times within one order, the order shall be fulfilled within the time limit applicable to the goods with the longest lead time.
Goods are delivered exclusively in the territory of the Republic of Poland.
Goods purchased in the Store are delivered depending on the method of delivery chosen by the Buyer: 
Through a courier company
Through the Polish Postal Service
The Buyer may collect the goods in person at the company's premises during its opening hours.
If the Buyer chooses to collect the goods in person, the goods will be ready for collection on the indicated order completion date, and if the Seller has indicated a date for sending the goods - on that date.
§ 7 RIGHT OF WITHDRAWAL
The Consumer has the right to withdraw from the contract concluded with the Seller via the Shop, subject to § 8 of the Terms and Conditions, within 14 days without giving any reason.
The period to withdraw from the contract expires after 14 days from the date: 
On which the Consumer came into possession of the goods or on which a third party other than the carrier and indicated by the Consumer came into possession of the goods.
On which the Consumer has taken possession of the last of the goods or on which a third party, other than the carrier and indicated by the Consumer, has taken possession of the last of the goods in the case of a contract involving the transfer of ownership of multiple items which are delivered separately.
The conclusion of the contract - in the case of a contract for the supply of digital content.
In order for the Consumer to exercise his/her right of withdrawal, he/she must inform the Seller, using the data provided in § 2 of the Terms and Conditions, of his/her decision to withdraw from the contract by an unequivocal statement (for example a letter sent by post or information provided by e-mail) and must have a document confirming the purchase of the goods at MOTOHILL.PL (invoice or receipt).
The consumer may use the model withdrawal form at the end of the Regulations, but it is not obligatory.
In order to meet the deadline for withdrawal, it is sufficient for the Consumer to send information concerning the exercise of his/her right of withdrawal before the expiry of the deadline for withdrawal. 
The goods to be returned must not bear signs of use.

EFFECTS OF WITHDRAWAL
In the event of withdrawal from the concluded contract, the Seller shall reimburse to the Consumer all payments received from the Consumer, including the costs of delivery of the goods (with the exception of additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest ordinary method of delivery offered by the Seller), immediately and in any case no later than 14 days from the day on which the Seller was informed of the Consumer's decision to exercise the right of withdrawal.
The Seller shall refund the payment using the same means of payment that were used by the Consumer in the original transaction, unless the Consumer agrees to a different solution, in any case the Consumer shall not incur any fees in connection with the refund.
The Seller may withhold reimbursement until it has received the goods or until it has been provided with proof of return, whichever event occurs first.
The Seller requests that goods be returned to the address: Kacice 86, Pułtusk, 06-100 Poland immediately and in any case not later than 14 days from the day on which the Consumer informed the Seller about withdrawal from the sales contract. The deadline is met if the Consumer sends back the goods before the expiry of the 14-day period.
The Consumer shall bear the direct costs of returning the goods.
The Consumer shall only be liable for any diminution in the value of the goods resulting from the use of the goods other than what was necessary to ascertain the nature, characteristics and functioning of the goods.
If the goods, due to their nature, cannot be sent back in the usual way by post the Consumer shall also have to bear the direct costs of returning the goods. The estimated amount of these costs will be informed by the Seller in the description of the goods in the Shop or when placing the order.

§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The Consumer has no right of withdrawal from a contract concluded at a distance in relation to a contract: 
In which the object of the performance is a non-refabricated item, produced to the Consumer's specifications or serving to satisfy his individualised needs.
In which the object of the performance is an item that is perishable or has a short shelf life.
In which the object of the performance is an item supplied in sealed packaging which cannot be returned after opening for health or hygiene reasons, if the packaging has been opened after delivery.
In which the object of the performance is things which are, by their nature, inseparable from other things after delivery.
In which the subject matter of the performance is sound or visual recordings or computer programs delivered in sealed packaging if the packaging has been opened after delivery.
On the supply of newspapers, periodicals or magazines, with the exception of a subscription contract.
Where the price or remuneration is dependent on fluctuations in the financial market which are beyond the trader's control and may occur before the end of the withdrawal period.
For the supply of digital content which is not recorded on a tangible medium if the performance has begun with the consumer's express consent before the end of the withdrawal period and after the trader has informed the consumer of the loss of the right of withdrawal.
§ 9 COMPLAINTS
In the event of a defect in the goods, the Buyer has the possibility to complain about the defective goods on the basis of the warranty or guarantee regulated in the Civil Code, provided that the guarantee has been granted.
Using the warranty, the Buyer may, according to the principles and within the time limits specified in the Civil Code: 
Make a declaration to reduce the price
In the case of a material defect, make a declaration to withdraw from the contract
Request a replacement of the item with a defect-free item
Demand removal of the defect
The Seller asks to submit complaints on the basis of the warranty to the postal or electronic address indicated in § 2 of the Terms and Conditions.
If it turns out that in order to consider the complaint it is necessary to deliver the complained goods to the Seller, the Buyer is obliged to deliver the goods, in case of a Consumer at the Seller's expense, to the address 86 Kacice Street Pultusk 06-100 Poland.
If a guarantee has been additionally granted for the goods, information about it and its conditions is available in the product description in the Shop.
Complaints regarding the operation of the Store should be sent to the e-mail address specified in § 2 of the Terms and Conditions.
Complaints shall be considered by the Seller within 14 days. 

OUT-OF-COURT COMPLAINT AND CLAIM PROCEDURE
In case the complaint procedure fails to bring the result expected by the Consumer, the Consumer may use, among others: 
Mediation conducted by the locally competent Provincial Inspectorate of Trade Inspection, to which a request for mediation should be submitted. As a rule, the proceedings are free of charge. The list of Inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
The assistance of a locally competent permanent amicable consumer court operating at the Provincial Inspectorate of Trade Inspection, to which a request for consideration of the case before the amicable court should be submitted. Free assistance from the municipal or district consumer ombudsman.

§ 10 PERSONAL DATA
The administrator of personal data provided by the Buyer while using the Shop is the Seller.
The Buyer's personal data is processed on the basis of the agreement and for the purpose of its implementation, in accordance with the principles set out in the General Regulation of the European Parliament and of the Council (EU) on data protection (RODO). Detailed information on the processing of data by the Seller is contained in the privacy policy posted in the Shop.
§ 11 DISCLAIMERS
The provision of unlawful content by the Buyer is prohibited.
Each time an order is placed in the Shop, it constitutes a separate sales contract and requires a separate acceptance of the terms and conditions. The contract is concluded for the time and purpose of fulfilling the order.
Contracts concluded on the basis of these regulations shall be concluded in the Polish language.
None of the provisions of these terms and conditions shall exclude or in any way restrict the rights of a Consumer arising from the provisions of law.
The provisions concerning goods shall apply accordingly to digital content, unless the Regulations specify these issues separately.
 

§ 12 POSTANOWIENIA DOTYCZĄCE KUPUJĄCYCH NIEBĘDĄCYCH KONSUMENTAMI
Prawo odstąpienia od umowy zawartej na odległość nie przysługuje podmiotowi innemu niż Konsument.
Wszelka odpowiedzialność Sprzedawcy w stosunku do Kupującego niebędącego Konsumentem jest wyłączona.
In case of ewentualnego sporu z Kupującym niebędącym Konsumentem sądem właściwym będzie sąd właściwy dla siedziby Sprzedawcy.

§ 3 TECHNICAL REQUIREMENTS

§ 4 ACCOUNT
The creation of an Account is entirely voluntary and depends on the will of the Buyer.
An Account gives the Buyer additional possibilities, such as: viewing the history of orders placed by the Buyer in the Shop, checking the status of an order or editing the Buyer's data on his own.
In order to set up an Account, an appropriate form must be filled in the Shop.
The moment an Account is created, an agreement is concluded for an indefinite period of time between the Buyer and the Seller on the maintenance of the Account under the principles specified in the Rules and Regulations.
The buyer may without incurring any costs at any time resign from the Account.
In order to resign from the Account, one should send his/her resignation to the Seller at the e-mail address: weimapl@gmail.com, which will result in the immediate deletion of the Account and the termination of the Agreement with regard to the operation of the Account.

§ 5 COMPLAINTS
Complaints regarding the functioning of the Account should be addressed to the e-mail address: motohillpl@gmail.com .
Complaints shall be considered by the Seller within 14 days.

§ 7 DISCLAIMERS

In the event of important reasons referred to in paragraph 4, the Seller shall have the right to amend these terms and conditions of the Account.
Valid reasons referred to in paragraph 3 are: 
the need to adapt the Store to the provisions of law applicable to the operations of the Store
improvement of security of the provided service
change of the functionality of the Account requiring modification of the Account regulations.
The Buyer shall be informed of a planned change to the Account Rules at least 7 days prior to the change coming into effect via an e-mail sent to the address assigned to the Account.
In the event that the Buyer does not agree with the planned change, he shall inform the Seller by sending an appropriate message to the Seller's e-mail address motohillpl@gmail.com , which will result in termination of the agreement regarding the provision of an Account from the moment the planned change comes into effect, or earlier if the Buyer submits such a request.
If the Buyer has not objected to the planned change by the time it comes into force, he shall be deemed to have accepted it, which shall not constitute any obstacle to the termination of the agreement in the future.
In the case of a potential dispute with a Buyer who is not a Consumer, the competent court shall have jurisdiction over the Seller's registered office.
None of the provisions of these terms and conditions exclude or in any way restrict the rights of the Consumer under the law.
Terms and conditions of the newsletter
of the Motohill shop

§ 1 DEFINITIONS
Newsletter - a service provided free of charge by electronic means, by which the Customer may receive from the Service Provider by electronic means pre-ordered messages concerning the Shop, including information on offers, promotions and news in the Shop.

Customer - each entity using the Newsletter service.
§ 2 Newsletter
The Newsletter service may be used by the Customer on a voluntary basis.
In order to use the Newsletter service it is necessary to have a device with a web browser in the latest version, supporting JavaScript and cookies, with access to the Internet and an active e-mail account.
Emails sent within this service will be sent to the email address provided by the Customer when signing up for the Newsletter.
In order to conclude an agreement and sign up for the Newsletter service, the Customer shall first provide his/her email address to which he/she wishes to receive messages sent under the Newsletter in the space provided on the Site. The Service Provider will then send an email to the email address provided in the first step, which will contain a link to confirm the Newsletter subscription by the Client. Upon confirmation of the Customer's wish to subscribe to the Newsletter, a service agreement is concluded and the Service Provider will commence providing the service to the Customer.
The Customer may unsubscribe from the Newsletter, without giving any reason or incurring any costs, at any time by sending a message to the email address of the Service Provider: motohillpl@gmail.com.
Sending a message with a request to unsubscribe from the Newsletter will result in immediate termination of the agreement for the provision of this service.
§ 3 Complaints
Complaints regarding the Newsletter should be reported to the Service Provider at the e-mail address:  motohillpl@gmail.com .
The Service Provider shall respond to complaints within 14 days of receiving the complaint.
§ 4 Personal Data
The administrator of the personal data provided by the Customer when using the Newsletter shall be the Service Provider.
The Customer's personal data shall be processed on the basis of the agreement and for the purpose of its implementation, in accordance with the principles set out in the General Data Protection Regulation of the European Parliament and of the Council (EU) (RODO). Detailed information on the processing of data by the Service Provider is contained in the privacy policy posted in the Shop.
§ 5 Final provisions
The Service Provider reserves the right to amend these Terms and Conditions only for important reasons. An important reason shall be understood to be the necessity to amend the regulations due to modernisation of the Newsletter service or change of legal regulations affecting provision of the service by the Service Provider.
Information about the planned change to the rules shall be sent to the Customer's email address provided at the time of signing up for the Newsletter at least 7 days before the change comes into effect.
If the Service Recipient does not object to the planned changes by the time they come into force, he/she is deemed to accept them.
If the Client does not accept the planned changes, the Client should send information about this to the Service Provider's e-mail address: motohillpl@gmail.com, which will result in the termination of the service agreement as soon as the planned changes come into effect.
The provision of unlawful content by the Client is prohibited.
